Document summary

The Law Commission of England and Wales and the Scottish Law Commission are carrying out a three-year review to prepare law and regulation for automated vehicles. This is a summary of the second consultation paper in that review. Our first consultation paper (Consultation Paper 1) considered safety assurance together with civil and criminal liability. This paper looks at the use of self-driving vehicles to provide journeys to users who are purely passengers. In the language of Consultation Paper 1, we consider vehicles that can be used without a user-in-charge. In other words, there is no person in the vehicle with legal responsibility for its safety.
